Terms of Service
Last updated
These terms explain what SimplyAI does, what you are responsible for, and how plans, credits and payments work. Please read them: by creating an account or using SimplyAI you agree to them.
On this page
The short version
- SimplyAI is an AI marketing service for businesses. You must be 18 or over and use it for business.
- Nothing goes live without you. Campaigns are created paused in your own Meta or Google Ads account and start only when you confirm.
- You pay Meta or Google directly for ad spend. SimplyAI never charges or marks up your ad spend.
- Monthly allowances refresh every 30 days and don't roll over. Bonus credits (video packs and gifts) don't expire with the monthly reset. Failed generations give credits back automatically.
- Card payments are handled by Polar as merchant of record. You can cancel any time; your plan runs to the end of the paid period.
- AI can make mistakes. Review everything before you publish. Results are not guaranteed.
This summary helps you read the terms. The full terms below are what apply.
1. Accepting these terms
These terms are an agreement between you and SimplyAI ("SimplyAI", "we", "us") for the use of simplyai.one and the SimplyAI app (the "service"). Our Privacy Policy explains how we handle personal information and forms part of these terms. If you use SimplyAI for a company or other organisation, you confirm that you are allowed to accept these terms for it, and "you" includes that organisation.
2. Who can use SimplyAI
- You must be at least 18 and able to enter into a binding agreement.
- SimplyAI is for business use, including sole traders and freelancers. It is not designed for personal or household use.
- You may not use SimplyAI if the law forbids you from doing so, or if we have previously closed your account for breaking these terms.
- If the law where you live treats you as a consumer, you keep any rights that law gives you, and nothing in these terms takes them away.
3. Your account and security
- Give us accurate information about yourself and your business, and keep it up to date.
- Keep your login details secure and don't share your password. You are responsible for activity in your account, including actions by anyone you allow to use it.
- Tell us straight away at support@simplyai.one if you think someone has accessed your account without permission.
4. The service
SimplyAI is a self-service AI marketing service. It reads the website you give it, builds a business profile and brand kit, and helps you plan campaigns and create ad copy, images, videos, landing pages and follow-up emails. Where you connect your own accounts, it can publish and manage campaigns and posts within the rules you set. Some channels are available only as exports or manual posting until direct publishing is offered, and you can always choose an export file (for example the "Download for Meta Ads Manager" or Google Ads Editor file) instead.
SimplyAI gives you tools and suggestions. It is not a law firm, an accountant or a regulated adviser, and it does not provide legal, tax or financial advice.
5. Businesses in your account
- You can add several businesses (workspaces) to one account, up to a limit we set to prevent abuse. Each business has its own profile, content, leads, controls and connections, and its data is kept separate from other businesses.
- Your plan, monthly allowances and credits belong to your account (your login) and are shared across all the businesses you manage.
- Only add businesses you own or are authorised to market.
6. You stay in control
- You choose a control mode (Review First, Assisted or Autopilot), the channels, spend limits, dates and countries SimplyAI may use. We act only within those authorisations and never increase your total authorised spend on our own.
- In Assisted and Autopilot modes, SimplyAI may pause weaker ads and raise or lower daily budgets automatically, always within your limits, and records what it changed and why in your history.
- You can pause all advertising for your business at any time.
- Ad platforms may deliver slightly more than a daily budget on some days. SimplyAI enforces your limits by monitoring spend and pausing with headroom, so limits are safeguards rather than exact guarantees to the cent.
7. Plans, subscriptions and renewal
- SimplyAI has a free plan and paid monthly plans. What each plan includes and costs is shown on the pricing page and in Billing.
- Paid plans are billed monthly in advance and renew automatically each month until you cancel.
- A plan is activated only after the payment provider confirms the payment. When a new plan starts, its monthly allowances replace the previous ones.
- If a renewal payment fails and can't be collected, the subscription ends and your account moves to the free plan. Your businesses, content and bonus credits stay in your account.
- We may change our plans and prices. Price changes apply to new purchases straight away. We will give you notice before a price change applies to an existing subscription, and you can cancel before it does.
8. Cancelling
- You can cancel any time from Billing → Manage subscription (Polar's customer portal), or by emailing support@simplyai.one.
- Cancellation takes effect at the end of the current billing period. Your plan stays active until then, and your account then moves to the free plan.
- Cancelling a plan doesn't delete your account or data. To delete them, see the data deletion instructions.
9. Credits and allowances
- Monthly allowances. Each plan includes a number of growth plans, image credits and video credits. They refresh every 30 days. Unused allowances do not roll over.
- Credit costs. Some actions use credits, for example generating images, landing pages or videos. The cost is shown on the button before you start, and current costs are listed on the pricing page. We use your monthly allowance first, then any bonus credits.
- Bonus credits. Credits from video packs you buy, and complimentary credits that SimplyAI grants (for example as a goodwill gesture), are bonus credits. They don't expire with the monthly reset, and they stay in your account if you cancel or move to the free plan.
- Failures. If a generation fails, the credits it used are returned to your account automatically.
- No cash value. Credits and allowances are a right to use SimplyAI features. They have no cash value, can't be exchanged for money (except as described under Refunds or where the law requires) and can't be transferred or sold to anyone else. They end when your account is closed.
- We may correct credits that were added by mistake, or remove credits obtained through abuse, fraud or a payment that was refunded or reversed.
10. Payments, prices and taxes
- Card payments for plans and video packs are processed by Polar (polar.sh), which acts as merchant of record. That means Polar is the seller on your receipt: it processes the payment, calculates and collects any applicable sales tax or VAT, issues invoices and receipts, and handles refunds and payment disputes. Polar's own terms also apply to the purchase.
- Prices are shown in US dollars. Whether tax is added on top depends on where you are, and is shown at checkout before you pay.
- Where we offer other payment methods, for example cryptocurrency through NOWPayments, the payment is processed by that provider and you buy directly from SimplyAI. A cryptocurrency payment covers one billing period and does not renew automatically.
- You authorise the payment provider to charge your payment method for the plan you choose, at the start of each billing period, until you cancel.
11. Refunds
- Subscription fees are not refundable, including for partly used periods, except where the law requires a refund or we decide to make an exception (for example after a technical problem on our side).
- Video packs: if you haven't used any credits from a pack, you can ask for a full refund within 14 days of buying it.
- To ask for a refund, email support@simplyai.one from the email address on your account. Approved refunds are paid through the provider you paid with, to the original payment method where possible.
- When a payment is refunded, we may remove the plan or credits it paid for.
- We can't refund advertising spend you paid to Meta or another ad platform. That is between you and the platform.
- If you dispute a payment with your bank or card issuer instead of contacting us, we may pause paid features while the dispute is open. Please contact us first: it is usually faster.
12. Advertising on Meta and Google, and ad spend
- To publish Facebook and Instagram ads you need your own Meta ad account, a Facebook Page and a payment method in that ad account. You connect them through Meta's login and choose which assets SimplyAI may use. To publish Google Search ads you need your own Google Ads account with billing set up; you connect it through Google's sign-in and choose the account SimplyAI may use.
- Campaigns are always created paused in your own ad account. They go live only when you confirm the launch, for example by choosing to activate when you publish, or by resuming a campaign.
- Direct billing (default, and currently the only option): you pay Meta or Google directly for advertising, using the payment method on your own ad account. SimplyAI does not charge or mark up this spend.
- Managed billing (not currently offered): if we offer it in the future, you would prepay an amount for advertising through SimplyAI plus a management fee shown before you pay. Prepaid funds are advertising prepayments held for your campaigns, not a bank account or stored-value wallet, and cannot be transferred. Funds that are not reserved for a live campaign and not spent can be refunded on request. Funds reserved for live campaigns or already spent are not refundable, and management fees are not refundable once the related funds have been used.
- Meta's terms and Advertising Standards, and Google's advertising policies, apply to your ads. Each platform reviews ads and may reject them or restrict accounts. We are not responsible for their decisions.
- If your ads relate to housing, employment, credit, financial products, social issues, elections or politics, you must declare the correct special ad category and follow the extra rules that apply.
- If you disconnect Meta or Google in SimplyAI, we first pause the campaigns we manage for you there, then remove our access. If the connection stops working for another reason (for example an expired login), we stop managing your campaigns until you reconnect, but campaigns already running keep running in your ad account until you pause them there or reconnect.
- Campaigns you import yourself with the "Download for Meta Ads Manager" or Google Ads Editor files are created and run entirely in your own ad accounts. SimplyAI can't see, pause or manage them.
- Marketplaces and product feeds. When SimplyAI lists your products on a marketplace (for example eBay, Amazon or TikTok Shop) or gives Google or Meta your product feed, you are the seller: the marketplace's seller terms and product policies apply, you are responsible for your products, prices, stock, shipping, taxes and customer service, and each marketplace decides whether a listing is accepted. Listings are created only after you approve them; listing packs you upload yourself are entirely in your own seller account.
13. Your content
- "Your content" means what you or your business put into SimplyAI: business information, website content we read at your request, uploaded files, approvals, and the leads you collect. You keep ownership of your content.
- You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt (for example resize or reformat), send and display your content only as needed to provide, secure and support the service for you, including sending it to the service providers listed in our Privacy Policy. This licence ends when your content is deleted, except for copies we must keep by law or that remain for a limited time in backups.
- You confirm that you have the rights and permissions needed for your content, including logos, photos, trademarks and any people shown, and that you may ask us to read the website you give us.
- If you send us feedback or ideas, we may use them without any obligation to you.
14. AI-generated content
- As between you and SimplyAI, you own the plans, copy, images, videos, landing pages and emails we generate for you ("output"), and you may use them for any lawful purpose, including commercially. To the extent we have any rights in output, we assign them to you.
- AI output may not be unique: similar output may be generated for others. The law in some countries gives limited copyright protection to AI-generated material.
- AI can be wrong. Output can contain mistakes, inaccurate claims, odd text or images, or material that resembles someone else's work. Review everything before you approve or publish it, and only approve claims you can support.
- You are responsible for your ads, landing pages, emails and offers, and for making sure they are truthful and comply with the law (including advertising, consumer protection, privacy and industry rules) and with each platform's policies, including Meta's Advertising Standards. Our safeguards, such as the forbidden-claims list, help but don't replace your review.
- Forecasts and estimates are predictions, not promises.
15. Acceptable use
You must not use SimplyAI to:
- promote anything illegal, or break any law or regulation;
- create deceptive, misleading or fraudulent ads, fake reviews or testimonials, or false claims about prices, results, health or money;
- discriminate unlawfully, including in housing, employment or credit advertising, or break the targeting rules for special ad categories;
- infringe anyone's copyright, trademark, privacy or other rights, or impersonate a person or business;
- advertise products or content prohibited by Meta's Advertising Standards or by law (for example illegal drugs, weapons, adult content or unsafe supplements);
- send spam, or email people who have not consented or who have unsubscribed;
- create hateful, harassing, violent or sexually explicit content, or content that exploits or harms children;
- access other customers' data, probe or break our security, or disrupt or overload the service;
- scrape, copy, resell or reverse engineer SimplyAI, or use it to build a competing product, except where the law allows this despite these terms;
- get around credit costs, plan limits, rate limits or safeguards, for example by creating multiple accounts to reuse free allowances.
16. Landing pages, leads and emails
- For leads collected on your landing pages, you are the controller of their personal information and SimplyAI processes it on your behalf, as described in our Privacy Policy.
- You are responsible for having a lawful basis to collect and use lead information, for the consent wording and privacy information on your pages, and for responding to your leads' privacy requests.
- Follow-up emails are sent only to leads who gave consent, and every email includes an unsubscribe link. Don't use SimplyAI to email people who haven't agreed to hear from you.
- We may pause sending if bounce or complaint rates suggest the emails are unwanted.
- If you need a data processing agreement for your leads, email support@simplyai.one.
17. Third-party services
SimplyAI works with services run by other companies, such as Meta, Polar and our AI providers. When you connect or use them, their own terms also apply. We are not responsible for their decisions or availability, such as ad rejections, account restrictions, outages or changes to their features or prices.
18. No guarantee of results
Advertising results depend on many things outside our control, including your offer, your market, your budget and the ad platforms. SimplyAI does not guarantee any number of leads, sales, bookings or any return on ad spend. Forecasts are estimates, and results are shown as reported by the ad platforms and as you record them.
19. Availability and changes to the service
- We work to keep SimplyAI available and reliable, but it may sometimes be unavailable, for example during maintenance or when a provider we depend on has an outage.
- We improve SimplyAI continually and may add, change or remove features, AI models or providers. If we remove a major paid feature, we will tell you in advance where we reasonably can.
20. Suspension and closure
- You can close your account at any time by emailing support@simplyai.one from the email address on your account.
- We may suspend or close accounts that break these terms, don't pay, put others at risk or must be closed by law. Where possible, we will tell you why and give you a chance to fix the problem first.
- We may pause advertising platform-wide in an emergency.
- When an account is closed, access ends and we delete your data as described in our Privacy Policy. Export anything you want to keep first. Sections that by their nature should continue (such as payments owed, your content licence for backups, disclaimers, liability and indemnity) survive closure.
21. Disclaimers
SimplyAI is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including that the service or its output will be uninterrupted, error-free, fit for a particular purpose, non-infringing or that it will achieve any result.
22. Limitation of liability
- To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, revenue, data or goodwill, or for advertising spend decisions you authorised.
- Our total liability for all claims relating to SimplyAI is limited to the amount you paid us for the service in the 12 months before the event that led to the claim.
- Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.
23. Indemnity
To the extent the law allows, you will defend and compensate SimplyAI against claims, losses and costs (including reasonable legal fees) brought by third parties that arise from your content, your ads, landing pages and emails, your use of leads' data, or your breach of these terms or the law.
24. Governing law and disputes
If you have a problem, please contact us first at support@simplyai.one so we can try to resolve it informally. These terms are governed by the laws of the country in which SimplyAI is established, without regard to conflict-of-law rules. This does not take away any mandatory protection you have under the law of the country where you live.
25. Changes to these terms
We may update these terms. If changes are material, we will update the date above and let you know in advance by email or in the app. If you keep using SimplyAI after the changes take effect, you accept them. If you don't agree, you can cancel before they take effect.
26. General
- These terms, the Privacy Policy and any terms shown when you buy something are the whole agreement between you and us about SimplyAI.
- If part of these terms can't be enforced, the rest still applies.
- If we don't enforce a right straight away, we haven't given it up.
- You may not transfer your account or these terms without our written permission. We may transfer them as part of a reorganisation, merger or sale of SimplyAI.
- We aren't responsible for delays or failures caused by events outside our reasonable control.
- We may send you notices by email to the address on your account or in the app.
